If you have a sales person closing a sale and they fill in a finance application for the client does that make them an intermediary, ie do they need to be a Credit Rep?
A person acts as an intermediary where they, either directly or indirectly, act as a conduit between credit provider and consumer for the purpose of securing credit for the consumer. This is a broad definition which is intended to capture all of the people acting as links in the chain between credit provider and consumer, including those who prepare or pass on information, as the result of a request by a consumer or by another intermediary, and their role is wholly or partially to secure credit or a lease.
To act as an intermediary is to engage in a credit activity. Therefore, intermediaries need to be licensed, or authorised as a credit representative, unless an exemption applies.
